Process serving is the legal procedure of delivering court documents to an individual or business involved in a legal case. It ensures that all parties are formally notified of legal proceedings, allowing them the opportunity to respond.
We serve a wide range of legal documents, including:
• Summonses and Complaints
• Subpoenas
• Divorce Papers
• Court Orders
• Statements of Claim
• VCAT (Victorian Civil and Administrative Tribunal) documents
• Letters of Demand
• Eviction Notices
• Other legal documents requiring formal service
Any person over the age of 18 who is not a party to the case can serve legal documents. However, process serving must follow strict legal procedures. Hiring a professional process server ensures compliance with the law and avoids delays caused by improper service.
Our standard service includes 3 attempts at the provided address. If the respondent is not available, we will make further attempts at different times of the day to increase the chances of successful service.
If service cannot be completed after multiple attempts, we will contact you to discuss the next steps. This may include obtaining further information, conducting additional investigations, or preparing an Affidavit of Attempted Service to assist with an application for substituted service.
If we are unable to serve your documents, we will provide you with an Affidavit of Attempted Service outlining our efforts. Depending on the court’s requirements, you may need to apply for substituted service or other alternatives.
In this case, we will contact you to discuss the next steps and complete any necessary paperwork specific to the relevant court, ensuring you have everything required for your application.
Once your documents have been successfully served, we will provide you with an Affidavit of Service as proof of delivery. This legal document confirms the date, time, location, and method of service.
You can then submit the affidavit to the relevant court as required. If you need any assistance with this process, we are happy to guide you through the next steps.
We will notify you as soon as service has been completed. You will receive confirmation via either email/phone call/SMS, along with an Affidavit of Service, which serves as legal proof that the documents were delivered.
If you require urgent updates, please let us know, and we can keep you informed throughout the process.
In most cases, the respondent does not need to sign for the documents for service to be legally valid. If they refuse to accept them, our process servers will leave the documents in their presence and record the details of the service attempt. We will then provide an Affidavit of Service confirming delivery.
However, some court documents — such as certain family law documents and subpoenas —may have specific service requirements, including personal acknowledgment or signing. If this applies to your case, we will advise you on the best approach and any additional steps that may be required.
If the respondent actively avoids service, we will discuss further options with you, such as applying for substituted service through the court.
